People Power Party lawmaker Jeong Yeon-wook said on the 5th about Lee Jae-myung, the leader of the Democratic Party, requesting a review of the constitutionality of the law, "It's a clear cowardice disguised as a delay tactic in the trial." A review of the constitutionality of a law is a system in which the Constitutional Court adjudicates the constitutionality of laws, and if the court requests a review, the trial is suspended until the court's decision is made. The court may also dismiss the request without seeking a review.
Lawmaker Jeong noted that "the provision of the Public Election Act, Article 250, Paragraph 1, which the representative Lee's side claims is unconstitutional, has already been ruled constitutional by the Constitutional Court" and added, "The impeachment trial against President Yoon Suk-yeol demands a speedy resolution, while delaying his own trial, which is an example of 'I am right, and others are wrong.'"
Representative Lee was sentenced to one year in prison with a two-year probation in the first trial for allegations of spreading false information under the Public Election Act and applied for a review of the constitutionality of the law in the court of appeal the previous day. Representative Lee's side argues that the 'actions' prohibited by Article 250, Paragraph 1 of the Public Election Act are ambiguous. The Constitutional Court ruled constitutional on this matter in 2021.
