Law firm Won said on the 31st that attorney Kang Jeong-u published a book that covers contract practice in international defense trade, "Conditions of defense export contracts: export and introduction, contract practice in international defense trade."
With the expansion of K-defense exports, this book analyzes the legal risks of international defense contracts that are growing in importance and compiles the key terms and response measures to review during contract execution as a practical guide.
It addresses major issues that can arise in the defense export process, including Incoterms (Incoterms 2020), governing law and the U.N. Convention on Contracts for the International Sale of Goods (CISG), letters of credit, independent bank guarantees, export controls, offset, technology transfer, and follow-on logistics support.
While handling litigation and advisory work in defense and the defense industry, Kang focused on cases where corporations, despite having technological capabilities and competitiveness, suffered disputes or losses because they did not properly design contract terms, and wrote the book. The focus is on explaining the design principles of contract terms that can preemptively control risks that may arise in the actual defense export process, rather than on simple methods of drafting contracts.
In addition to Supreme Court and lower court precedents in Korea, it introduces major cases from the United States, the United Kingdom, Germany, Japan, and the Court of Justice of the European Union. It also includes sample defense export contracts, step-by-step checklists, and an English contract expression glossary that corporate practitioners and legal experts can use.
