A man in his 60s who served time for sex crimes against minors and others and was ordered to stay in at night after his release was fined after leaving his residence in the early morning hours.
According to legal sources on the 27th, Judge Gi Hee-gwang of the Jeonju District Court Criminal Division 3 sentenced A, 67, who was indicted on charges of violating the Act on Electronic Monitoring, to a fine of 100,000 won.
A was brought to trial on charges of leaving the protective facility where he was living without justifiable reason for about 100 minutes from 2:36 a.m. to 4:12 a.m. on Oct. 9 last year.
He was repeatedly punished for sex crimes, receiving a six-year prison sentence in 2011 on charges of housebreaking and rape and, in 2020, a five-year prison term on charges of forcible molestation of a minor.
After the sentence ended, the court ordered A to wear a location-tracking electronic device until 2039 and imposed a compliance requirement not to go out from midnight to 5 a.m.
The court said, "The defendant violated the compliance requirements despite receiving a heavy sentence and a long-term order to wear a location-tracking electronic device," noting, "It is necessary to impose a severe punishment because it undermines the judiciary and probation functions of state institutions and could lead to other crimes."
However, the court said it took into account that A did not go far outside the facility but stayed in another room in the same facility, making the degree of illegality somewhat minor.
