Bae, Kim & Lee LLC (BKL) launched an "online content regulation response task force (TF)" in line with the enforcement of the amended Act on Promotion of Information and Communications Network Utilization and Information Protection.
Bae, Kim & Lee said that as the management responsibilities of online platforms and content service providers have been strengthened, the need has grown to respond in an integrated manner, from content reporting, deletion, and blocking to user disputes, supervisory authority investigations, and damages claims.
The TF is led by attorney Park Ji-yeon, head of Bae, Kim & Lee's TMT group. Attorneys in broadcasting and telecommunications, media and platforms, personal information protection, and administrative regulation will participate to build corporation-specific regulatory response systems.
Attorney Yoon Ju-ho; attorney Jeong Sang-hun, who handled platform, personal information protection, and governance work at Naver for about 15 years; and attorneys Lee Jun-ho and Sang Ji-young will serve as the TF's core members.
Senior advisor Cho Kyung-sik, who served as the 2nd Vice Minister of the Ministry of Science and ICT and as Secretary-General of the Korea Communications Commission, and senior advisor Hwang Seon-cheol, formerly of the Korea Communications Commission, will also participate. Drawing on their experience in government policy formulation and execution, they plan to provide advice on statutory and policy interpretation and strategies for responding to supervisory authorities.
Antitrust attorneys Kim Gyu-sik and Kim Chi-yeol and compliance attorneys Song Jin-uk and Kim Ji-ina will also join. For dispute response, attorney Yoon Hwa-rang, who served as a research judge at the Supreme Court, and attorney Lim Hyo-ryang, a former presiding judge at the Suwon District Court, will participate.
In criminal matters, attorney Park Seung-hwan, who served as the 1st deputy chief prosecutor at the Seoul Central District Prosecutors' Office, and attorney Park Seong-beom, who worked in the Investigation Planning Division of the Investigation Bureau at the Korean National Police Agency, will support related investigations and responses.
The TF's main tasks are: ▲ analyzing the impact of the amended Act on Promotion of Information and Communications Network Utilization and Information Protection and its subordinate regulations on corporations ▲ building compliance systems ▲ designing procedures for content reporting, deletion, blocking, and prevention of re-distribution ▲ responding to supervisory authority investigations and administrative procedures ▲ addressing legal risks such as user disputes, damages, and penalty surcharge.
Attorney Park Ji-yeon said, "This amendment is meaningful in that it not only strengthens online content regulation but also makes corporations' content management systems and overall digital governance subject to legal responsibility," adding, "There is a need to review compliance systems suited to service characteristics and to establish a comprehensive framework capable of responding to user disputes and supervisory authority investigations."
