A woman in her 40s who went on trial on a charge of assaulting a man in his 20s who secretly filmed her in a women's restroom was sentenced to a fine.
On Feb. 1, Judge Seok Dong-woo of the Changwon District Court Criminal Division 4 Single-Judge Panel said he sentenced a woman in her 40s, identified as A, to a fine of 300,000 won on a charge of assault.
A was sent to trial on a charge of repeatedly punching in the face a man in his 20s, identified as B, who secretly filmed her urinating in a women's restroom on the first floor of a building in Seongsan-gu, Changwon, South Gyeongsang, at about 5:40 a.m. on Dec. 8, 2024.
It was found that in Dec. 2023, B received a suspended sentence of one year and two months in prison with three years of probation on charges including violating the Act on Special Cases Concerning the Punishment of Sexual Crimes (filming and distribution using cameras, etc.).
A's side argued there was no assault against B, but the court found that an assault occurred. The court cited as grounds the fact that B confessed to the illegal filming while consistently testifying about being assaulted. The court also found it hard to see that B fabricated the assault claim, given that B was under a suspended sentence period and needed to reach a settlement with A.
The court determined it could not be seen as legitimate self-defense or as a justifiable act not contrary to social norms, considering that A did not stop at blocking the exit with a leg to prevent B, who was apologizing for the filming, from fleeing, but also assaulted B's face about 15 to 17 times.
