Law firm Jipyung will hold a seminar on "Response plans for differential franchise fees and the Korea Fair Trade Commission's law enforcement direction in the franchise sector" at its headquarters in Jung-gu, Seoul, on the 12th of next month.
Jipyung said it is holding the seminar because many lawsuits have been filed seeking the return of differential franchise fees as unjust enrichment from franchisors. Even if disputes do not proceed to litigation, many franchisors are exposed to related legal risks, and the need to conduct a prior review of issues related to differential franchise fees as part of future business strategy reviews is growing.
Jipyung's fair trade group plans to comprehensively analyze the latest precedents and regulatory trends surrounding differential franchise fees and share practical response measures through this seminar. It will also examine recent regulatory trends in the franchise sector and discuss response measures by corporations.
Specifically, the seminar will consist of two presentations and a discussion. First, partner attorney Kim Sang-yoon will give a presentation on "Response plans for differential franchise fee issues." Kim served as head of the franchise transactions investigation team at the Korea Fair Trade Commission, handled numerous major cases in the franchise sector, including issues related to mandatory items, and is a fair trade expert with broad practical experience across the field.
Next, partner attorney Lee Jong-heon will give a presentation on "The Korea Fair Trade Commission's law enforcement direction in the franchise sector." Lee is a fair trade specialist with extensive experience handling fair trade cases and strong compliance capabilities. In the subsequent discussion and Q&A, partner attorney Lee Byung-joo will moderate and, together with the presenters, discuss "the Franchise Business Act in general, including differential franchise fee issues."
Partner attorney Lee Byung-joo said, "A recent Supreme Court ruling surrounding differential franchise fees is becoming an important turning point that calls for a reexamination of the overall franchise business structure," adding, "I hope this seminar will clarify the meaning of the key rulings and help franchisors prepare practical response strategies to minimize future dispute risks."
