Shin & Kim LLC will hold a seminar on mergers and acquisitions (M&A) in the defense industry and regulations on foreign investment. As exports of K-defense expand and demand grows for investment in defense companies, equity acquisitions, and joint ventures, the need for legal and regulatory review at each transaction stage has increased.
Shin & Kim LLC said it will host the first Gwanghwamun defense forum at 2 p.m. on the 15th in the seminar room on the 24th floor of Gran Seoul in Jongno-gu, Seoul. The forum will examine practical issues, focusing on key disputes in the process of buying and selling defense companies and points to note when foreigners enter or invest in the defense sector.
In the first session, attorney Lee Su-gyun will present key issues and cases related to the purchase and sale of defense companies. Unlike general corporations transactions, defense company transactions will address the importance of approval procedures under relevant laws, security, and business structure reviews.
In the second session, attorney Kim Sung-jin will explain practical issues that must be checked during the transaction process, such as security measures. Drawing on experience at the Ministry of National Defense, the Defense Acquisition Program Administration, and the Navy Logistics Command, the session will cover regulations, procedures, and risk response measures to be reviewed at the transaction stage.
In the final session, foreign attorney Kim Se-jin will present notes for foreigners entering or investing in the defense sector. As supply chain and economic security issues overlap in strategic industries such as defense and shipbuilding, foreign investment procedures and trade and security regulations are expected to be discussed together.
Shin & Kim LLC has recently expanded its defense sector organization. Participants include adviser Kim Jung-soo, a former chief of naval operations, adviser Kang Jung-hee from the Defense Acquisition Program Administration, and attorney Kim Sung-jin, who worked at the Ministry of National Defense and the Defense Acquisition Program Administration. Shin & Kim LLC said this forum will serve as an opportunity to review institutional risks that corporations face in defense transactions and investment processes.
