The court dismissed an injunction filed by Jeonbuk State Gov. Kim Kwan-young, who was expelled from the Democratic Party of Korea over alleged cash handouts, challenging the party's expulsion decision.
The Seoul Southern District Court Civil Agreement Division 51 (Chief Judge Kwon Sung-su) on the 8th dismissed both Gov. Kim's request to suspend the effectiveness of his expulsion from the Democratic Party and his request to halt the primary procedures for the Jeonbuk governor candidate.
The court said, "Based solely on the submitted evidence, it is difficult to conclude that the expulsion failed to meet the requirements for an emergency disciplinary action, that it was procedurally unlawful for not sufficiently providing an opportunity to explain, or that it is unlawfully excessive in light of the circumstances."
On the request to halt the primary procedures, the court said, "As the request presupposes a suspension of the effectiveness of the expulsion and the injunction seeking such suspension has been dismissed, it is also difficult to accept the injunction request in this case."
Kim is suspected of having paid proxy driving fees to young people during a dinner at a restaurant in Jeonju, Jeonbuk, in Nov. last year.
The Democratic Party of Korea launched an emergency inspection on the 1st at the direction of leader Jung Chung-rae and expelled Kim that night at a supreme council meeting. Kim filed for an injunction in court the following day.
