A man in his 40s who raped his teenage daughter was sentenced to prison.
According to legal sources on the 23rd, the 2nd Criminal Division of the Chuncheon District Court recently sentenced A, 42, to 10 years in prison on charges of violating the Act on Special Cases Concerning the Punishment of Sexual Crimes (rape of a minor under 13 and rape by a family member).
In Sept.–Oct. 2022, A forced his daughter B, 12, who was in the living room, to come into the master bedroom of his residence in Gangwon Province and coerced her into a quasi-sexual act or had sexual intercourse. A was brought to trial on charges of raping a victim under 13 who was also a family member.
The investigation found that immediately after the crime, A told B, "I'm sorry, don't tell anyone."
The case led to an investigation after B was physically abused by her biological father in Dec. 2024 and moved to a shelter, where the full story emerged during counseling.
During the trial, A's side partially denied the charges, arguing, "It is true that acts as stated in the indictment occurred, but there was no rape at the time."
However, the court did not accept this. The court said, "The defendant had a duty and responsibility to care for the victim, a child, so that she could grow up properly, yet raped the victim, who was only 12," and added, "Given the method and nature of the crime and the relationship between the two, the culpability is very grave." The court also said, "The defendant has not been forgiven by the victim," in explaining the sentencing.
However, the court added, "In determining the sentence, we considered several factors, including that the defendant admitted most of the facts of the crime and showed remorse, and that, aside from one fine for an offense of a different type, there is no record of prior criminal punishment."
