The Seoul Central District Court's Criminal Division 35 (presiding judge Baek Dae-hyeon) on the 1st trial sentencing hearing held at 2 p.m. on the 16th for former President Yoon, who was indicted on charges including "obstructing arrest," found Yoon guilty of violating the Presidential Records Management Act.
The court said, "Director General of the Presidential Secretariat Kang Uigoo kept the (post-facto martial law proclamation) in a desk drawer in his office after the signatures were completed in Dec. 2024, then, after receiving a request for disposal from Han Duck-soo (former prime minister), reported this to the defendant and disposed of it on Dec. 10, 2024."
It continued, "Therefore, the act of disposing of the document in collusion with Prime Minister Han Duck-soo and Director General of the Secretariat Kang Hee-gu by the defendant is deemed to constitute the crime of violating the Act on the Management of Presidential Records and the crime of damaging official documents."
