Seongnam Development Corporation filed for provisional seizure of 747.3 billion won in assets held by the Daejang-dong group including Kim Man-bae.
According to Seongnam city on the 2nd, Seongnam Development Corporation the previous day filed 13 applications for provisional seizure with the Seoul Central District Court, Seoul Southern District Court, and Suwon District Court, targeting the real estate and deposits of private operators in Daejang-dong.
The total amount subject to provisional seizure is 747.3 billion won: 600 billion won for Kim Man-bae, 82 billion won for Nam Uk, 64.69 billion won for Jung Young-hak, and 675 million won for Yoo Dong-gyu.
Seongnam Development Corporation was said to have asked to freeze the entirety of the assets formed through the Daejang-dong development, encompassing various forms of criminal revenue such as deposit claims, real estate, trust profit rights, and damages claims.
A Seongnam city official said, "This provisional seizure was carried out with the goal of recovering the Daejang-dong group's overall criminal revenue (land lot sale dividends, apartment and other sales revenue, etc.) that the state and prosecutors have given up on."
The city was also said to be pursuing a "return of crime victim property" for the full 112.8 billion won that the first trial court recognized as Seongnam Development Corporation's damages.
A "return claim" is a procedure in which a person who suffered property damage from a corruption crime applies to the state to return the criminal revenue recognized in court as subject to forfeiture or collection to the actual victim.
Seongnam city said, "By pursuing a claim for damages through civil litigation in parallel with a claim for the return of criminal revenue through criminal procedures, we are diversifying channels to restore citizens' losses."
