A man in his 40s, a person surnamed An, who was indicted and detained on charges of trying to enter the Chinese Embassy and a police station while dressed as the protagonist of the U.S. film "Captain America," was also sentenced to one year and six months in prison on appeal. It is the same sentence as in the first trial.
The Seoul Central District Court Criminal Appeals Division 9-2 (Presiding Judges Ryu Chang-seong, Jeong Hye-won and Choi Bo-won) on the 25th dismissed An's appeal on charges including attempted unlawful entry into a structure and handed down the same sentence of one year and six months in prison as the first trial.
The court said that day, "Given An's motive and intent in committing the crimes, the considerable impediment this caused to police officers' performance of their duties, and the impact on public authority, it is difficult to alter the lower court's sentence."
Earlier, on the evening of Feb. 14, a person surnamed An was questioned by police on suspicion of attempting to trespass into the Chinese Embassy in Korea while wearing a Captain America outfit. Later, on the night of the 20th of the same month, after he tried to enter the interior by breaking the glass of the first-floor entrance door of Namdaemun Police Station, he was arrested in the act and was indicted and detained in March. He also faced charges of verbally abusing a police officer during the disturbance.
An also presented a "fake U.S. military ID" to police, leading to charges of forgery and use of private documents. An allegedly claimed he was U.S. Central Intelligence Agency (CIA) "black agent" Capt. Michael Peters. However, according to prosecutors, he was found to be a Korean, a former Army staff sergeant with no U.S. entry record.
In May, the first trial found all of An's charges guilty and sentenced him to one year and six months in prison. An appealed, arguing the first-trial sentence was too heavy.
