A legal basis has been established for security guards to manage waste separation and parcel deliveries in addition to facility security duties.
The Korean National Police Agency announced on the 8th a legislative notice for a revision of the Enforcement Decree of the Security Industry Act containing these details. This revision adds to the facility security duties of security guards: ▲ assistance with cleaning and beautification ▲ monitoring and organizing the separation of recyclable resources ▲ parking management and storage of parcel items. The revision will take effect on Jan. 8, 2026.
Previously, Article 7, Paragraph 5, and Article 19, Paragraph 1, Subparagraph 2 of the Security Industry Act mandated the cancellation of security business licenses if the licensed security duties were exceeded by engaging in waste separation or parcel management. However, there have been ongoing criticisms that the law does not reflect the actual working conditions of apartment security guards and others.
As a result of this regulation, a company whose security business license was revoked filed an administrative lawsuit, and the court referred the case for a constitutional review based on a party's request. Accordingly, the Constitutional Court made a decision of unconstitutionality by a 6 to 3 vote in 2023. This revision is a follow-up measure based on the Constitutional Court's decision.
