On the 26th, Shin & Kim LLC (CEO Oh Jong-han) announced that it has published '50 Questions and Answers about the Yellow Envelope Law' online.
The Yellow Envelope Law (amendment to the Labor Union and Labor Relations Adjustment Act) expands the scope of employers and targets of labor disputes, and limits corporations' claims for damages against striking workers. It passed the National Assembly on the 24th.
Shin & Kim noted, "With the passage of the bill, various issues such as the collective bargaining relationships between primary and subcontractors and methods of negotiation may arise immediately, thus, the Shin & Kim Labor Group has prepared this guideline to minimize corporate confusion regarding the interpretation and application of the amended Labor Union Law and to assist with prompt and accurate responses." Previously, Shin & Kim also launched a task force (TF) for the Yellow Envelope Law.
The guideline is structured into four categories: ▲ employer status of primary contractors ▲ expansion of labor disputes ▲ expansion of union membership ▲ limit on claims for damages, containing a total of 50 questions and answers. The aim is to enhance the understanding of the Yellow Envelope Law and provide key points needed in the field.
Many experts in labor law participated in drafting the guideline. Participating experts include lawyer Kim Dong-wook (36th Judicial Research and Training Institute), lawyer Cho Chan-young (29th), a former judge in the labor division of the Seoul High Court, lawyer Kim Jong-soo (37th), a specialist in collective labor relations consulting and litigation, as well as lawyers Yoon Hye-young (40th), Song Woo-yong (40th), and Yang Joo-yeol (1st bar exam).
