On that day, Park Ji-young, the Deputy Special Prosecutor for Insurrection, said, "We received a response from the Seoul Detention Center indicating that there are no issues with his conduct," adding, "We plan to submit the relevant information as evidence."
Deputy Special Prosecutor Park stated, "Currently, Deputy Special Prosecutor Park Eok-soo, Director General Cho Jae-cheol, and three other prosecutors are participating in the review of the legality of the detention," noting, "The day before (17th), we submitted an opinion document of over 100 pages arguing that continued detention is necessary."
Former President Yoon was detained by the Special Investigation Team for Insurrection on the 10th on charges of obstruction of official duties and abuse of power. The reason for detention was concerns over potential evidence destruction. In response, Yoon's side claimed that the detention measure by the Special Investigation Team for Insurrection is illegal and unjust, and they requested a review of the legality of the detention from the court.
The review of the legality of detention is a procedure where the court examines and determines the legitimacy of the suspect's detention and the necessity for continued detention. The court assigns a judge to the case, and that judge must conduct a hearing of the suspect and review evidence within 48 hours of the request. Subsequently, the court will decide on the necessity of detention by evaluating compliance with detention requirements and procedures, potential concerns of evidence destruction, or flight risk. During this period, the Special Investigation Team's investigation into Yoon will be suspended.
