Former Minister of National Defense Kim Yong-hyun's petition against the additional indictment by the special investigation team regarding the insurrection was dismissed by the Seoul High Court on the 25th. Dismissal means that the court concludes the case without hearing it due to lack of litigation requirements.
The Criminal Division 20 of the Seoul High Court (Chief Judge Hong Dong-ki) made a dismissal ruling on the petition by former Minister of National Defense Kim regarding the special investigation team's additional indictment.
Earlier, the special investigation team led by Jo Eun-seok added new charges against former Minister Kim for obstruction of the execution of official duties by deception and for instigating the destruction of evidence, and requested the court to issue a warrant for arrest.
Former Minister Kim filed a petition against the special investigation team's additional indictment and requested a stay of execution. The stay of execution was already dismissed by the Seoul High Court on the 21st.
Former Minister Kim's side claimed that the special investigation team's additional indictment was "merely intended to prevent the expiration of the detention period and to block the effectiveness of the bail decision."
Previously, former Minister Kim was arrested and indicted on December 27 last year on charges of engaging in important duties related to insurrection, and the first instance detention period ends on the 26th. Once the detention period expires, former Minister Kim will be able to stand trial without any restrictions. In response, the prosecution applied for bail. The court granted bail under conditions including residence restriction, a guarantee of 100 million won, and not contacting individuals involved in the case such as former President Yoon Suk-yeol.
Former Minister Kim's side appealed against the court's bail decision, but the Seoul High Court dismissed the appeal on the 24th.
Meanwhile, the Criminal Division 34 of the Seoul Central District Court (Presiding Judge Han Sung-jin) is conducting a hearing to determine whether to issue an additional arrest warrant for former Minister Kim.
