The application for a temporary injunction filed by Chairperson Lee Jin-sook of the Korea Communications Commission to stop the execution of duties by Kim Yoo-yeol, the president of EBS, was dismissed by the court.
On the 26th, the Uijeongbu District Court's Goyang branch announced that it had dismissed the temporary injunction request filed by creditor the Republic of Korea (the responsible agency being the Korea Communications Commission) and independent party participant Commissioner Lee Jin-sook.
The court determined that the case was not lawful, as the lawsuit was initiated by an agent without proper authority.
According to the law regarding lawsuits involving the state, the Minister of Justice represents the Republic of Korea in cases where the Republic of Korea is a party, and the Minister of Justice must appoint a lawyer as the litigation representative.
The court explained, "In this case, the power of attorney submitted by the creditor's litigation representative was drafted as 'Chairperson Lee Jin-sook, representative of the Korea Communications Commission,' and it is not a power of attorney indicating that the representative is appointed by the Minister of Justice, thus it is not lawful."
The court also found it hard to acknowledge that the appointment authority of the KCC president had been violated. Currently, since the request for a temporary injunction to suspend the appointment effectiveness of Shin Dong-ho, EBS's new president, has been granted, Kim is in the position of executing his duties. The court's judgment is that this procedure is according to the Korea Educational Broadcasting System Act and is unrelated to the KCC's appointment authority.
Earlier, the KCC submitted a request for a temporary injunction to suspend the duties of President Kim Yoo-yeol to the Uijeongbu District Court's Goyang branch last month.
Following the administrative court's decision to grant a temporary injunction to suspend the appointment effectiveness of Shin Dong-ho, EBS's new president, the KCC requested another court to prevent this just three days after Kim returned.
