A woman who reported to the police that a man she was in a relationship with attempted to rape her was sentenced to prison in the first trial on charges of false accusation. Investigations revealed that the woman filed a false complaint to ensure that the man was punished despite having never attempted to rape her.
The Seoul Central District Court Criminal Division 3 (Director General Lee Jong-min) acknowledged the false accusation charges against a woman in her 40s, identified as A, and sentenced her to four months in prison on the 15th.
The court stated, "A made false statements claiming she was almost raped, and then prepared a complaint with details to substantiate this," adding, "The nature of the crime is very poor, making a prison sentence unavoidable."
In 2023, A visited a motel in Seoul with a man in his 40s, identified as B, with whom she was in a relationship, and caused a disturbance by throwing objects after a dispute with an employee. Ultimately, A was charged with obstruction of business by the police.
A blamed B for the situation, demanding, "It's your fault, you resolve it," and, "Pay for the expense of 10 million won for the lawyer." When B refused these demands and cut off contact, A went to B's workplace and told him, "I will go to your wife's company."
Due to this issue, A received a restraining order from the court prohibiting her from approaching B. In response, A accused B of rape, claiming, "He forcibly took me to a motel to attempt to rape me when I was in a state of diminished mental capacity."
In turn, B filed a counter complaint, resulting in A being arrested and indicted for false accusation in August 2023. During the trial, A claimed, "I passively stated the elements of the crime of rape according to the advice of detectives and others, so the illegality is minimal." However, the court did not accept her argument and sentenced her to prison.
