Yoon's attorney, Yoon Gap-geun, stated this through a media announcement that day. The 25th Criminal Division of the Seoul Central District Court (Judge Ji Kwi-yeon) will conduct the first preparatory hearing for the rebellion leader charges against President Yoon and the hearing requested by President Yoon's side for the cancellation of his arrest starting at 10 a.m. on the 20th. At 3 p.m. on the 20th, the 10th hearing for President Yoon's impeachment trial will take place at the Constitutional Court.
According to the Criminal Procedure Act, a court must cancel an arrest either on its own authority or by the request of the prosecutor, defendant, or attorney if there is no justification for the arrest or if it has been extinguished. Cancellation of arrest means nullifying the arrest itself, which is different from bail, which temporarily releases the person under certain conditions such as payment of a bond.
It is said that it is rare for the defendant's side to request cancellation of an arrest when the first trial has not yet officially begun. Some in the legal community analyze that President Yoon's side may have chosen to pursue cancellation of the arrest to emphasize their claim of 'illegal detention'. They may also have considered that the likelihood of bail being granted is low.
