The defense team for President Yoon Suk-yeol, who has been arrested and indicted on charges of insurrection, filed a motion to cancel his detention with the court.
According to the legal circles on the 4th, President Yoon's team submitted the detention cancellation request to the 25th Criminal Division of the Seoul Central District Court, presided over by Judge Ji Gui-yeon.
According to the Criminal Procedure Act, if there are no grounds for detention or they have been extinguished, the court must cancel the detention either ex officio or by a request from prosecutors, defendants, or defense attorneys.
Unless there are exceptional circumstances, the court must decide on whether to cancel President Yoon's detention within seven days from the date it received the request for cancellation.
