The constitutional appeal of Kwon Do-hyung, a central figure in the Terra·Luna incident and co-founder of Terraform Labs, who is undergoing an extradition trial in Montenegro, has been dismissed. On the 24th (local time), according to local media such as Vijesti and Pobjeda, the Constitutional Court of Montenegro unanimously dismissed Kwon's constitutional appeal and confirmed that the authority related to extradition rests with the Minister of Justice.
The constitutional appeal aimed to assess whether the Supreme Court's decision to nullify Kwon's extradition to South Korea and transfer the authority to the Minister of Justice was legally justified. Kwon's side argued procedural unfairness, but the Constitutional Court concluded that there was no violation of the right to a fair trial or to family life.
With the Constitutional Court's decision, the extradition proceedings for Kwon will resume, and Montenegrin Justice Minister Bojan Božović will make the final decision. Local media reported that, based on current circumstances, Kwon is more likely to be extradited to the United States. The Montenegrin government may prefer extradition to the United States over South Korea from a national interest perspective, and considering that the South Korean Supreme Public Prosecutors' Office objected twice to the extradition to South Korea, it is analyzed that the Montenegrin Ministry of Justice supports extradition to the United States.
However, Kwon's side may attempt additional legal actions to prevent extradition to the United States, leaving the timing of the extradition uncertain. The South Korean Ministry of Justice and the South Korean Embassy in Serbia have reportedly requested to prevent unnecessary human rights violations due to delayed legal proceedings.
Kwon is accused of causing damage exceeding 50 trillion won due to the Terra·Luna collapse. He left for Singapore in 2022, traveled through the UAE and Serbia, and entered Montenegro but was arrested for using a forged passport. His extradition process has not yet been completed.
