Minister Kim Young-hoon of the Ministry of Employment and Labor (MOEL) said he is examining in various ways whether to revise an enforcement decree or enforcement rule to set criteria for the "scope of industrial action" under the yellow envelope law, a new labor law aimed at strengthening the bargaining rights of subcontract workers (amended Trade Union and Labor Relations Adjustment Act).
At the full meeting of the National Assembly's Climate, Energy, Environment and Labor Committee on the 12th, when People Power Party lawmaker Na Kyung-won asked, "Regarding the yellow envelope law, President Lee Jae-myung also said, 'Isn't it vague? Change the subordinate legislation.' Have you decided to create the subordinate legislation?", Minister Kim answered accordingly.
Minister Kim said, "At the work report, I reported that we would proceed by guideline, and the president issued repeated instructions at the Cabinet meeting the day before," adding, "We are examining in various ways what methods might be available, such as an enforcement decree or enforcement rule." He added, "I thought we could sufficiently resolve the ambiguity with a work guideline, but instructions were given to review a more concrete institutionalization rather than a guideline."
In response, lawmaker Na said, "The yellow envelope law itself is framed with vague provisions, and the aspect of employer status also needs to be clarified," adding, "There is no specific delegation clause in the law, and doing this by subordinate legislation could invite constitutional controversy."
On whether to ease the 52-hour workweek in the Honam semiconductor mega special zone, he drew a line, saying nothing has been decided yet. When lawmaker Na asked, "Is it your position that researchers in the mega special zone are an exception to the 52-hour workweek?", Minister Kim answered, "Nothing has been decided by the government yet."
