YouTuber Tzuyang (real name Park Jeong-won) voiced concern after the YouTuber who threatened her and received a prison sentence said a petition for retrial would be filed.
On the 18th, attorney Kim Tae-yeon, Tzuyang's litigation representative, and People Power Party lawmaker Kim Jang-kyom held a press conference at the National Assembly and issued their position.
That day, Kim criticized the notice by YouTuber Gu Jaeyeok (real name Lee June-hee), whose prison term was finalized for extorting tens of millions of won, to file a petition for retrial, saying, "Judicial destruction to save President Lee Jae-myung alone is resulting in making innocent victims cry."
Kim went on, "The side effects of the three judicial destruction laws pushed through by the Lee Jae-myung administration and the Democratic Party of Korea are already appearing in reality," adding, "The Democratic Party packaged it as if it were a system to expand the people's rights, but the reality is the exact opposite."
Kim said, "Criminals whose sentences have been finalized in court are now abusing the petition-for-retrial system to go all the way to the Constitutional Court to try to overturn the rulings," adding, "It opens a path for offenders to drag out trials further while foisting pain and anxiety onto victims."
Attorney Kim, who attended the press conference, conveyed Tzuyang's current state of mind. Kim said, "Victim Tzuyang was happy only briefly after the final ruling, and when she heard the news of the petition for retrial, she worried whether she had to wait for another ruling again," adding, "Because of the petition-for-retrial system, victims now face a situation where pain they believed was over is repeated."
Earlier, attorney Kim So-yeon, the legal representative for Gu Jaeyeok, whose three-year prison term was finalized for threatening Tzuyang and extorting money, claimed on the 12th via social networking service (SNS) that the court violated six constitutional provisions, including Gu's rights to private life and equality.
In a handwritten letter released by attorney Kim, Gu said, "Please reveal the injustice through a petition for retrial," and requested, "Please send the full texts of the Petition for Retrial Act and the crime of legal distortion." In response, attorney Kim said, "We can only thank the Democratic Party and President Lee Jae-myung for pushing the three judicial reform laws so that unconstitutional investigations and trials in areas such as evidentiary admissibility and evidentiary assessment can be corrected," adding, "We will do our best to reveal the substance of this case and correct what is wrong."
