National Assembly Speaker Woo Won-sik said he would proceed with legal proceedings regarding the appointment of Constitutional Court Justice Ma Eun-hyeok against Acting Prime Minister Han Duck-soo.

On the afternoon of the 28th, Woo noted in a press release, "We will take all possible measures, including legal proceedings, in the future."

Legal proceedings refer to the Constitutional Court judging disputes over responsibilities and powers between state agencies.

Previously, Woo had also filed a legal proceeding against Acting Prime Minister Choi Sang-mok, who was serving as the acting president, on the grounds that he violated the National Assembly's authority by not appointing Ma as the candidate for the National Assembly's selection.

On the 27th of last month, the Constitutional Court unanimously ruled the act unconstitutional. In other words, the court ruled that the acting president's failure to appoint the candidate violated the authority of the National Assembly.

Speaker Woo expressed his intention to reclaim the National Assembly's rights through legal proceedings against the current acting prime minister, just as he did with the former acting prime minister.

Woo explained, "It has been over a month since the Constitutional Court's ruling on the unconstitutionality of the non-appointment of Justice Ma Eun-hyeok, and although Han Duck-soo returned as acting president on March 24, 2025, the failure to appoint Ma as a Constitutional Court justice is a serious situation leading to a prolonged unconstitutional state."

In addition, Woo decided to file a request for a provisional disposition to determine the temporary status of Justice Ma Eun-hyeok.

The National Assembly also decided to send written questions to both the Constitutional Court and the acting prime minister. According to Article 122 of the National Assembly Act, which requires responses to written questions within ten days, Woo stated that he would actively take any measures available to resolve the unconstitutional state.

The speaker's office stated that they would ask the Constitutional Court about ▲ the validity of existing rulings and the confirmation of the unconstitutional state due to the non-appointment of Ma Eun-hyeok as a justice, and ▲ the official position regarding the reason the impeachment ruling of President Yoon Suk-yeol has not been made.

Woo remarked, "It is impossible to discuss the rule of law if Acting Prime Minister Han Duck-soo does not resolve the state of constitutional violation," adding that "the appointment of Justice Ma Eun-hyeok is a very critical precondition for restoring the damaged constitutional order, and we will take all possible measures going forward."
