Lee Jae-myung, leader of the Democratic Party of Korea, noted regarding the court's decision to cancel the arrest of President Yoon Suk-yeol that it was a "beginner's arithmetic mistake" by the prosecution, while also stating that President Yoon's charges of insurrection are not negated. He argued that it would not influence the ongoing impeachment trial of President Yoon at the Constitutional Court.
On the afternoon of the 7th, Lee met with reporters at the National Assembly and said, "Just because the prosecution made a basic arithmetic mistake, that does not eliminate the clear fact that President Yoon destroyed the constitutional order through an unconstitutional military coup," adding, "Insurrection is still ongoing, and overcoming the insurrection is currently our most significant task."
Lee stated, "Just because the prosecution made a mathematical error, it does not mean that there was no clear military coup or unconstitutional act, and I believe it will have no impact on the Constitutional Court's judgment," noting, "As we know, the public judges that it is an insurrection act, and the issue of procedural matters will be determined by the courts in the future."
He commented on the court's explanation regarding the unclear investigation authority of the Corruption Investigation Office for High-ranking Officials related to the duration of detention, saying, "Aside from the prosecution's errors regarding the detention period, it seems hard to find any other special issues," and added, "Together with the great people, I will surely complete the revolution of light."
The court ruled on this day to cancel the arrest of President Yoon Suk-yeol, who was arrested and indicted on charges of being the "leader of the insurrection." Once the arrest is canceled, the previously issued arrest warrant becomes ineffective. The decision to cancel an arrest is made when there was initially no reason for detention or when such reasons have disappeared after the arrest.
The prosecution can immediately appeal the court's decision to cancel President Yoon's arrest. President Yoon will be notified of the cancellation of arrest at the court, and the prosecutor will send a release order to the Seoul Detention Center before he is released. If the cancellation is finalized, President Yoon can attend both the Constitutional Court's impeachment trial and the criminal trial without being detained.
