Kweon Seong-dong, the floor leader of the People Power Party, noted on the 7th regarding the court's acceptance of the request for the cancellation of President Yoon Seok-yeol's detention, "Even if the prosecution files an immediate appeal, it cannot prevent the effect of the detention cancellation and release." This is because under the Criminal Procedure Act, prosecutors can immediately appeal the decision to cancel the detention, but in the past, the Constitutional Court has ruled that this regulation is unconstitutional.
After finishing an emergency press conference at the National Assembly that day, the floor leader stated to reporters, "The prosecution should not file an immediate appeal," adding, "According to the 2012 Constitutional Court decision, even if an immediate appeal is filed regarding the court's decision to suspend detention, the provisions in the Criminal Procedure Act that allow the suspension of detention to take effect were ruled unconstitutional."
He added, "If the prosecution files an immediate appeal claiming it can prevent the effect of the detention cancellation, that would violate the decision of the Constitutional Court, constituting a violation of the constitution," and emphasized, "The prosecution is an institution that defends the human rights of all citizens. The prosecution should not file an immediate appeal."
On the other hand, the Democratic Party views it as a "procedural issue" arising from the differing interpretations of the detention period by the prosecution and the court. It has called for the prosecution to file an immediate appeal, stating that the court's decision to cancel the detention has no relevance to the Constitutional Court's impeachment trial of the president and will not have any effect.
Park Kyun-taek, a member of the party and chairman of the legal committee, commented on the speculation about inadequate investigations by the Corruption Investigation Office for High-ranking Officials as a result of the court's decision, stating, "The court is not pointing out issues or acknowledging mistakes of the CIO," and added, "This is a matter of interpretation regarding the detention of President Yoon, not a reason to criticize the CIO."
