Samsung Electronics on the 18th shared inside the company part of the Suwon District Court's decision granting an injunction to ban unlawful industrial action and called the union's interpretation of "normal staffing" a clear distortion. It directly refuted the Samsung Electronics union's claim that the essential maintenance staffing specified by the court includes "weekends or holidays" and therefore does not interfere with industrial action.
Samsung Electronics that day posted an internal notice titled "Notice regarding injunction to ban unlawful industrial action." In the notice, the company said, "To prevent unlawful industrial action during the period of industrial action announced by the union, we filed on Apr. 16 for an injunction to ban unlawful industrial action, and today (the 18th) the court issued its decision," sharing the ruling.
Samsung Electronics highlighted parts of the ruling, including security work to prevent damage to work facilities or deterioration or spoilage of raw materials or products under Article 38, Paragraph 2 of the Trade Union and Labor Relations Adjustment Act, and the maintenance and operation of safety protection facilities under Article 42, Paragraph 2 of the Trade Union and Labor Relations Adjustment Act, and said, "The court decided that during the period of industrial action, work must be carried out normally at the same level as on ordinary days." It added, "The court decided to ban the occupation of facilities related to production and other major operations, including production and research lines, IOC, procurement warehouses, electrical and computing facilities, and storage facilities for explosive hazardous substances and toxic chemicals."
Regarding the meaning of "normal" as specified in the ruling, it said, "The Samsung Electronics chapter of the Samsung Group supra-enterprise labor union (supra-enterprise union) is claiming through a legal opinion posted on its website by Law Firm Majung that it means 'weekend or holiday' staffing, but this clearly distorts the court's decision," adding, "The court clearly stated in the written decision that 'normal' means 'a normal weekday or a normal weekend/holiday.'" It continued, "It is clear that during the period of industrial action, on weekdays it means maintaining safety protection facilities and security work with weekday-level staffing, and on weekends/holidays with weekend/holiday-level staffing," and said, "Based on the court's injunction, the company will later provide separate guidance to employees in departments that require normal attendance even during the period of industrial action."
Samsung Electronics concluded by saying, "We will continue to work to ensure the safety of our employees and minimize confusion at production sites," and added, "Regardless of the injunction, we will do our best to reach an amicable agreement in the 2026 wage negotiations."
