A request for a temporary restraining order by Elon Musk, CEO of Tesla, asking for an immediate halt to the discussions on OpenAI's transition to a for-profit corporation was dismissed by a U.S. court.
According to Reuters and Bloomberg, the U.S. District Court in Oakland, California, ruled on the 4th (local time) that Musk's request did not meet legal requirements and therefore would not be accepted.
However, the court stated it plans to proceed with the main trial quickly and announced it would hold hearings this fall, considering the public interest.
OpenAI welcomed the court's decision, stating, 'The content of Musk's emails includes his desire to merge OpenAI with Tesla,' and argued, 'Musk's personal interests took priority over OpenAI's mission or the interests of the United States.'
A representative for Musk reacted positively to the plan for a speedy hearing, stating, 'We expect the jury to confirm that while OpenAI accepted Musk's contributions, it is unfair to proceed in a profit-focused direction now.'
Musk participated as an investor in the establishment of OpenAI in 2015 but severed ties in 2018. After ChatGPT gained global attention in 2023, he filed a lawsuit, claiming OpenAI was focusing on profit-making activities contrary to its original purpose.
Meanwhile, Musk established the AI startup xAI in 2023 and launched the AI chatbot 'Grok' later that year.
