This is analyzed as being influenced by the U.S. Patent Trial and Appeal Board (PTAB) finding the relevant patent invalid in a post-grant review (PGR) conducted on the 12th (local time) regarding Halozyme's U.S. granted patent. This final decision is the first among the many PGRs filed by MSD.
The view is gaining traction that this final decision will lead to a result favorable to Alteogen and MSD. If Halozyme's foundational patent is found invalid, future ongoing patent infringement suits could also conclude in favor of MSD and Alteogen.
