Actor Kim Ga-yeon revealed the reason she was the only one to withdraw a libel lawsuit.
Im Yo-hwan and Kim Ga-yeon on Nov. 11 posted a video titled "The reason Kim Ga-yeon, who never agrees with malicious commenters, withdrew one lawsuit" on their YouTube channel 'Kim Ga-yeon In Yo-hwan's Game couple'.
Kim Ga-yeon explained how she filed her first lawsuit through a proxy and said, "I said I would sue via social media, but they mocked, laughed and ignored me. I gave them a few days, but they didn't do it. So I thought it wouldn't work, took a photo of the complaint I had written and posted that I would submit it, and the malicious commenters panicked. Some deleted posts, but I had given a deadline, and even if they deleted, the database remains."
Kim Ga-yeon disclosed how to sue, saying, "Even if they delete it, it can be used as evidence. You must capture the post's URL and take full screenshots of the post. The date and time must be visible. Mobile captures are not recognized as evidence. It must be done on a PC."
Kim Ga-yeon said, "The process of filing the suit took time, but as a result, nearly half of the people became those surveyed. I showed that to the malicious commenters as feedback. I proceeded with all the lawsuits by myself without a lawyer's help. When I was in college I took some elective law classes. I researched all the laws related to my case because at the time there were no lawyers who had experienced this. In fact, there were cases where lawyers asked me questions."
Im Yo-hwan said, "My wife was given the title 'queen of lawsuits' and many entertainers around her asked about it." Kim Ga-yeon said, "When filming variety shows, she said she was so envious of idols who do it bravely. At companies, ignoring and not responding was common, but they couldn't comfort their wounds, could they?" she said with regret.
Kim Ga-yeon said, "When I first started, there was a cyber safety agency. You go there and first file an application at your jurisdiction address. After you submit it like an inquiry, the police station assigns an officer. When the assigned officer contacts you, you give them the materials you collected. After investigating the case, a letter is sent to the person's home. The investigation results are compiled and passed to the prosecutor, and a criminal trial proceeds without the victim or perpetrator appearing. When the result comes out, it goes to the perpetrator and to me. Then it's over."
She added, "With the result notice you hire a lawyer and, based on the criminal trial result, file a civil suit to seek compensation for damages. Criminal and civil punishment is possible. The mental damage from being targeted once is great. When the perpetrator is punished after a lawsuit, there is some relief. I recommend filing a lawsuit no matter what."
Im Yo-hwan laughed, "When I started personal streaming the chat was messy, but when my wife enters the chatroom there's nothing but clean water. They only say proper things." Kim Ga-yeon said, "The moment I appear, they say, 'We didn't say anything.' That became a kind of meme they imitate. When my husband sees me enter, he says, 'That person has arrived.'" Im Yo-hwan stated his standard, "Unless a comment crosses a clear line, as long as they don't bother family and people around them, roasting me to that degree of malicious comments is fine."
Kim Ga-yeon did not show mercy to everyone. She said, "I said on a broadcast that I didn't forgive anyone, but I think I can tell this story. I withdrew one case. When the detective contacted me I didn't want to withdraw. Whether a middle schooler or anyone else, my basic principle is not to forgive, so I refused. Not long after, I received a call saying the parents wanted to meet together. I felt I should meet them once. It was the first time the parents asked to meet together."
She continued, "One of the parents came on crutches, and a middle schooler came behind them with a very frightened expression. I asked why they posted it, wondering if this child wrote the malicious comments. At the time, if you didn't do that you could be ostracized at school. Writing many such posts raised one's rank, and this student, even though the top in the school, left malicious comments to avoid being ostracized."
Kim Ga-yeon said, "To the child's mother I said, 'I usually don't withdraw lawsuits, but hearing the child's story I understood why they could not help it.' She cried so much I almost cried too. I told her that while it might have been for simple status at first, the child could later enjoy doing this, so being caught now and not doing it in the future was actually a good thing. I was the only one who withdrew in that case." She added, "The reason I said I never withdrew is that if what I said goes out on broadcasts or in articles, won't the person know? So I kept my mouth shut, and I assume they graduated college and became an adult. I think they grew up well."
Kim Ga-yeon said, "There's a saying that malicious comments are better than no comments, but that's nonsense. I hope people leave comments that tease appropriately. If it's funny, I'll even press like."
