Pop star Dua Lipa has filed a lawsuit worth about 22 billion won against Samsung Electronics.
On the 8th (local time), foreign media reported that Dua Lipa filed a lawsuit against Samsung Electronics and its U.S. affiliate Samsung Electronics America seeking damages for violation of portrait rights and copyright.
According to the U.S. Central District Court of California, Dua Lipa alleged that Samsung Electronics inserted her image on the front of TV product packaging boxes without permission and sold the products across the United States.
Dua Lipa's side said the photo is an image registered with the U.S. copyright office under the title "Dua Lipa - Backstage at Austin City Limits, 2024." They said it was used commercially without a license agreement or separate permission despite there being no official collaboration with Samsung Electronics, and that this could have led consumers to mistake Dua Lipa as an advertising model or to believe the products were a collaborative item between the parties.
Dua Lipa's side also alleged that Samsung Electronics used her image and reputation to boost product sales, constituting false advertising and false endorsement, and that although they requested a halt to sales and an end to the portrait rights infringement in June last year, sales continued without significant action. They are seeking at least $15 million (about 22 billion won), demanding an injunction to stop sales of the infringing products, compensatory damages, punitive damages and payment of attorney fees.
In the process, Dua Lipa's side also cited social media reactions. They said some customers purchased the products believing Dua Lipa was an advertising model for them. An X comment quoted in the complaint reportedly said, "I wasn't planning to buy a TV, but I saw Lipa on the box and bought it," and "Since there's a photo of Dua Lipa, I'll buy that TV."
Dua Lipa is a British singer who debuted in 2017. She remains a popular pop star who has won three Grammy Awards and seven Brit Awards to date.<
