A cast member identified as A, who appeared on I'm SOLO and NaSolSage (NaSol Four Seasons), was tried on charges of raping an intoxicated woman but avoided a prison sentence on appeal.
On the 7th, the Seoul High Court Criminal Division 14-1 (presiding judges Director General Lee Hyung-geun·Lee Hyun-woo·Jung Kyung-geun) sentenced A, who was tried on charges of quasi-rape, to 1 year and 6 months in prison with a three-year suspended sentence, the same as the first trial.
The court also ordered 40 hours of sex offender treatment lectures and a five-year ban on employment at institutions related to children, adolescents and persons with disabilities.
The court said the prosecutor appealed the first-trial verdict on the grounds of excessive sentencing, but it was difficult to view the lower court's sentence as having exceeded the reasonable range of discretion even considering that A showed remorse, had no prior criminal record and the victim agreed and did not want punishment, given the nature of the crime, and it maintained the lower court's ruling.
Earlier, A was referred to trial on charges of raping a woman in her 20s who was heavily intoxicated in a parking lot in Seogyodong, Mapo District, Seoul, in June last year.
The first trial court found him guilty based on the defendant's confession and the evidence, but considering that the defendant admitted the crime and showed remorse, that a settlement with the victim had been reached, and that he was a first-time offender, it imposed a suspended sentence.
The prosecution appealed on the grounds of excessive sentencing, but the second-instance court also upheld the original ruling and made the same judgment.
