Singer and actor Park Yuchun was freed from the '5.0 million won compensation' with his former agency.
According to a report by Star News on the 17th, management company Loud Fund Together (formerly Have Fun Together) withdrew the damages suit it filed on the 8th against Park Yuchun and his former agency Recielo. Park Yuchun, who had filed a counterclaim, also withdrew his suit, and with the case concluded, Park Yuchun's obligation to pay 50 million won and delayed interest was eliminated.
In January 2020, Loud Fund Together signed a contract to be delegated exclusive management rights for Park Yuchun by Recielo until 2024. However, in May 2021 Park Yuchun requested termination of his exclusive contract with Loud Fund Together, and after negotiations failed he and Recielo sent an official letter saying "if settlement payments are not made, the exclusive contract can be terminated."
Loud Fund Together remained unresponsive, and after notifying the termination of the contract Park Yuchun continued his entertainment activities through another management company, A Company, run by an acquaintance. Ultimately, in August 2021 Loud Fund Together filed a provisional injunction to prohibit Park Yuchun from broadcasting appearances and entertainment activities, and the court granted it.
Nevertheless, Park Yuchun violated the provisional injunction and continued activities with the new management, and Loud Fund Together sued Park Yuchun, Recielo and A Company for about 50 million won in damages, claiming they infringed on its management rights. The trial court ruled that "Park Yuchun violated the court's provisional injunction by engaging in entertainment activities through A Company without Loud Fund Together's consent, and Recielo actively participated in this," and ordered Park Yuchun and Recielo to jointly pay 50 million won and delayed interest to Have Fun Together.
In particular, Park Yuchun and Recielo claimed that Loud Fund Together did not pay settlement payments and that the exclusive contract had been lawfully terminated, but according to financial transaction information confirmed by the court the settlement payments were reported to have been paid on time. However, the court limited damages for Park Yuchun and others to activities conducted through another management company and did not accept Loud Fund Together's request to bar the artists from performing altogether.
At the appeal held in September last year the court upheld the first-instance ruling. However, during the appeal Recielo's counterclaim that "Loud Fund Together has some unpaid settlement payments" was partially accepted, and the court ordered Loud Fund Together to calculate the unpaid settlement amounts by item and pay Recielo 47 million won.
Separately, in 2019 Park Yuchun was prosecuted on methamphetamine use charges and was sentenced to 10 months in prison with a two-year suspended sentence. At the time he held a press conference and declared that if the charges were true he would retire from the entertainment industry, but even after a guilty verdict he reversed his retirement and is currently continuing activities overseas, including in Japan.
