A former NCT member who was expelled after being accused of gang sexual assault, Taeil, had his 3 years and 6 months prison sentence finalized.
On the 27th, according to legal sources, the day before the Supreme Court's 1st Division (presiding Justice Seo Kyung-hwan) dismissed the appeals filed by Taeil and two accomplices, who were indicted on charges of special rape under the Act on the Aggravated Punishment, etc. of Sexual Crimes.
Accordingly, Taeil will serve 3 years and 6 months in prison. they were also ordered to complete a 30-hour sexual violence treatment program and were barred from working for five years at institutions related to children·adolescents and people with disabilities.
Earlier, Taeil is accused of, along with two friends, drugging a Chinese woman they met at a bar in Itaewon, Yongsan District, Seoul, at around 2:33 a.m. on June 13 last year, putting her in a taxi to move her to their residence in Bangbae-dong, and gang raping the woman after she became extremely intoxicated and lost consciousness.
As a result, Taeil was dismissed from the group NCT, and his exclusive contract with SM Entertainment was also terminated. SM Entertainment said, "The company recently confirmed that Taeil was sued in a criminal case related to a sex crime. while ascertaining the facts in this matter, we recognized the seriousness of the matter and determined that he could no longer continue team activities, and after discussions with Taeil decided on his departure from the team."
With the first trial having begun in June, Taeil and the two accomplices admitted to their charges. Taeil appealed for leniency, saying, "I am very sorry to everyone who felt disappointed in me" and "If you show leniency, I will consider it the last chance given in my life and do my best to live by doing any work that can in any way contribute to society."
The first-instance court sentenced them to 3 years and 6 months in prison and ordered their detention in court. at the time, the court criticized, "The victim was a foreign tourist who suffered a crime in an unfamiliar place and appears to have suffered great mental anguish."
After the first trial, both sides appealed, but the second-instance court dismissed both appeals and upheld the original verdict, and the Supreme Court also dismissed the appeal, finding the grounds for appeal to be improper.
