EXO-CBX's side rebutted SM Entertainment's position and showed willingness to perform as a full group.
On the morning of the 30th, EXO-CBX's agency INB100 rebutted SM Entertainment's official position, saying, "This is INB100's response to SM Entertainment's official position."
That day EXO-CBX's side said SM's demand to pay 10% of solo activity revenue as set in the existing agreement, "EXO-CBX's intention to pay 10% of revenue remains unchanged, and since litigation is currently underway, it plans to carry this out once an agreement is reached and legal procedures are completed."
Earlier the day before, SM said the reason EXO-CBX could not participate in EXO's full-group activities was that "through excessive multiple disputes the trust between the parties has been greatly eroded, and because of the damage to the team EXO and the wounds caused to fans and members, it is proper that the existing agreement be fulfilled and the three members make sincere efforts to restore trust first."
In response EXO-CBX said, "All discussions proceeded on the premise of 'EXO full-group activities.' EXO-CBX clarified its intention to fulfill the existing agreement, communicated directly with the members, and has been trying to participate as part of the team."
EXO-CBX's side also said that contrary to SM's claim that "the three members clearly conveyed their intention to agree by accepting all the conditions we presented after the second mediation session on Oct. 2," they filed an objection first on the 16th, and added, "EXO-CBX conveyed to SM its intention to pay 10% of solo activity revenue around the court mediation date and was awaiting a final response," they said.
EXO-CBX's side went on to say, "However, the amount proposed by the mediator on Oct. 2 was an arbitrarily calculated figure unrelated to the parties' agreement, so both companies said at the mediation session that they could not accept it," and "after that amount was delivered in writing, both parties filed the same objection on Oct. 16. This was a procedural step and the claim that EXO-CBX has no intention to agree is not true."
EXO-CBX's side apologized sincerely to fans who felt confusion and concern during the legal process with SM and promised, "EXO-CBX will faithfully carry out the terms of the existing agreement and do its best to restore trust with the members and reach amicable consultations with SM."
Meanwhile, a recently released notice of EXO's group fan meeting said that for the year-end fan meeting and new album, six members — Suho, Chanyeol, DIO, Kai, Sehun and Lay — will participate without EXO-CBX.
EXO-CBX, which has continued its dispute with SM, is not participating in full-group activities. EXO-CBX's side said it accepted all conditions presented by SM for a year-end full-group comeback, but SM issued an EXO activity notice excluding EXO-CBX, they claimed.
SM said, "We have prevailed in all disputes to date, and what we asked of the three was only to pay 10% of solo activity revenue as set in the existing agreement. That has not yet been carried out," and added firmly, "Furthermore, participation in team activities is a matter where trust between the parties has been greatly eroded through multiple disputes, and because the wounds inflicted on EXO fans and members are significant, it is proper that the three make sincere efforts to restore trust first."

SM official position 1)
What we (SM) asked of the three (EXO-CBX) was only to pay 10% of solo activity revenue as set in the existing agreement dated June 18, 2023. However, this has not yet been carried out.
→ EXO-CBX's intention to pay 10% of revenue remains unchanged, and since litigation is currently underway, it plans to carry this out once an agreement is reached and legal procedures are completed.

Participation in team activities was a matter where, through excessive multiple disputes, the trust between the parties was greatly eroded, and because of the damage to the team EXO and the wounds caused to fans and members, it was proper that the existing agreement be fulfilled and the three make sincere efforts to restore trust first.
