Fifty Fifty is preparing to appeal regarding the copyright lawsuit for 'Cupid.'
On the 8th, Fifty Fifty's agency, Attract, stated, "As for the first trial lawsuit concerning the copyright of 'Cupid' with The Givers, Attract is currently preparing to appeal while conducting legal reviews."
Recently, the Civil Affairs Division 62 of the Seoul Central District Court (Director General Lee Hyun-seok) ruled that "the plaintiff's claim is without merit and is dismissed in its entirety" in a copyright verification lawsuit filed by Attract against The Givers.
Attract filed a lawsuit last year claiming that the copyright of 'Cupid' held by The Givers belongs to them and demanded a transfer.
Attract claimed that the copyright of 'Cupid' belongs to them, but the court recognized that the party to the copyright transfer contract is The Givers and that all substantial actions, including the execution of the contract, negotiations, and expenses, were carried out through The Givers. In particular, it stated that "contract interpretation must be done as written in the contract, not according to inner intent," affirming that The Givers' ownership of the creation rights is clear.
Furthermore, Attract argued that the service contract signed with The Givers included copyright acquisition work, but the court ruled that "this was not explicitly stated in the contract, and in fact, The Givers proceeded with the contract based on the creator's judgment, taking on high risks." The court determined that Attract's release of music using the master audio source and holding the copyright to the song are separate issues. In this context, Attract is preparing to appeal.
Meanwhile, a representative of The Givers noted regarding this ruling, "This ruling shows that The Givers' efforts to rectify the truth in a situation where false assertions are repeated were justified," and added, "The Givers has responded based on factual circumstances from the beginning, and we hope this ruling will serve as an objective benchmark in similar cases in the future."
