As the court determined that the five members of the group NewJeans should not engage in independent activities, ADOR
The Seoul Central District Court, Civil Division 50, presided over by Chief Judge Kim Sang-hoon, made a ruling on the 21st regarding the provisional injunction filed by ADOR against the five members of NewJeans (Minji, Hanni, Daniel, Haerin, HAEIN) to preserve the status of its agency and prohibit the signing of advertising contracts.
The court noted, "It is difficult to conclude that the creditor (ADOR) has sufficiently established that the debtors (the five members of NewJeans) violated significant obligations in this exclusive contract, leading to grounds for termination or that the trust relationship between the parties has collapsed irreparably. Therefore, it is likely that the five members of NewJeans will face restrictions on their activities as part of the new group NJZ."
In response, ADOR said in the afternoon, "We are deeply grateful for the wise judgment of the provisional injunction court," adding, "As ADOR, we have legally confirmed our status as the agency for NewJeans, and we will fulfill our responsibility in supporting the artists moving forward."
Moreover, ADOR stated, "This weekend, we plan to provide sufficient support on-site for the ComplexCon performance to be conducted under NewJeans' name, as represented by ADOR."
"ADOR hopes to quickly meet with the artists for an honest conversation. We sincerely ask for warm encouragement and support for NewJeans as they grow again with ADOR."
On Nov. 28 last year, NewJeans held an emergency press conference announcing the termination of their exclusive contract due to ADOR's breach. Following this, they announced plans for performances and new song releases under the new activity name NJZ last month.
Following NewJeans' press conference, ADOR filed a lawsuit for the confirmation of the validity of the exclusive contract with the Seoul Central District Court on Dec. 3 last year, and subsequently filed a provisional injunction to prevent the NewJeans members from independently engaging in activities such as signing advertising contracts without ADOR's approval or consent.
ADOR stated, "We applied for this provisional injunction to prevent confusion and harm to third parties such as advertisers caused by NewJeans members who unilaterally declared the termination of their exclusive contract, while continuing to attempt to contract with advertisers. The fact that the members' unilateral termination claims are unfair will be confirmed through the lawsuit ADOR filed for the validity of the exclusive contract. However, it may take a significant amount of time for the final judgment, so we had to urgently apply for an additional provisional injunction to mitigate the ongoing confusion."
