The actor Jung Woo-sung's son, born to model Moon Gabi, has attracted attention regarding his 'inheritance rights'.
Recently, a video titled 'How much right do the public have to know about celebrities' private lives?' was released on the YouTube channel 'Viewport'.
In the released video, cultural critic Ha Jae-geun and divorce attorney Yang Na-rae appeared, discussing the son born between Jung Woo-sung and Moon Gabi.
Jung Woo-sung was embroiled in a controversy regarding his private life after having an extramarital child with model Moon Gabi in December last year. Jung Woo-sung and Moon Gabi first met at a gathering in 2022, became close, and it is known that Moon Gabi became pregnant with Jung Woo-sung's child in June 2023.
Later, Jung Woo-sung attended the 45th Blue Dragon Film Awards and said, "I will take all the criticism and bear it. Additionally, as a father, I will take full responsibility for my son," promising his responsibility for raising the child, while Moon Gabi welcomed a healthy son in March last year.
In relation to this, Attorney Yang Na-rae noted, "It is not necessary for a child to be born within marriage to have inheritance rights. However, if I have given birth to an extramarital child, a separate recognition process must take place for the inheritance rights to occur."
She added, "When you pull up a family relationship certificate, both parents and children are all registered, but being a biological child does not automatically mean they appear on the family relationship certificate. If a child is born out of wedlock, the mother's child will be recognized immediately, but there is no way to ascertain who the father is. Therefore, there needs to be a DNA test, followed by a recognition claim, to legally register as the child. Once the child is registered alongside the original wife's children, that's when they attain equal inheritance rights."
She further explained, "So, when a recognition claim is made, they will naturally inherit. If a recognition claim is not made, they will not be able to inherit." She also predicted, "I think that (a recognition claim) will likely happen."
Attorney Yang further elaborated, "Even if Jung Woo-sung marries again and has another child, the inheritance rights remain equal; however, the spouse is 1.5 and the child is 1. The eldest child being an extramarital child does not decrease their value at all."
An analysis of Jung Woo-sung's statement, "As a father, I will take full responsibility for my son," was also conveyed. Cultural critic Ha Jae-geun speculated, "What that means is probably a legal acknowledgment that he will recognize the child as his."
Attorney Yang remarked, "In fact, when it is legally stated as 'I will fulfill my role as a father,' the first thing that comes to mind is the obligation to pay child support. However, even if it is a biological child, child support can be voluntarily provided without a recognition claim. This may not be accurate due to not knowing the circumstances of both parties, but for that legal obligation to arise, a recognition claim is essential."
