NCT member Taeyil (real name Moon Taeyil) has been indicted without detention on charges of raping a woman with acquaintances.
According to the legal community on the 4th, the Seoul Central District Prosecutors' Office, Women and Children Crime Investigation Division 1 (Director General Kim Ji-hye), referred Taeyil and two accomplices to trial for special robbery rape under the Sexual Violence Punishment Act on the 28th of last month.
Previously, Taeyil was accused of raping a drunken woman with two acquaintances in June last year. The Seoul Bangbae Police Station received a report from the victim, investigated Taeyil, and conducted summons investigations in August.
The police applied for an arrest warrant for Taeyil and two accomplices, but it was dismissed on the grounds that they acknowledged the crime, reducing the necessity for detention. Ultimately, the Seoul Bangbae Police Station transferred Taeyil without detention to the Seoul Central District Prosecutors' Office on September 12.
Additionally, as the police applied the charge of special robbery rape, suspicions arose whether a weapon was possessed at the time of the crime; however, it was reported that this was not true. The crime of special robbery rape constitutes a serious offense when a weapon is possessed or when two or more persons jointly copulate with a person unable to resist due to mental or physical incapacity. However, they did not possess a weapon.
If the charges are confirmed, he will face imprisonment of seven years or more, or life imprisonment, under Article 4, Section 1 of the Act on the Special Cases Concerning the Punishment of Sexual Violence Crimes.
As a result, Taeyil has been expelled from his group NCT, and his agency SM Entertainment has also announced the termination of his exclusive contract.
At that time, SM stated, "We inform you that the exclusive contract with Taeyil has been terminated as of October 15, 2024," adding, "Taeyil is currently under investigation by the prosecution due to a criminal complaint, which constitutes grounds for contract termination, and it is no longer possible to maintain trust as an artist, thus the decision to terminate the exclusive contract was made in agreement with him."
